We will strive to work with you to resolve these matters during this difficult transition time. In some situations, we will attempt to use family settlement agreement as a mean of equitable distribution of the estate assets. Our firm has experienced Social Security Disability attorneys who will assist you in obtaining the proper medical documentation to support your condition, prepare you for the appeal hearing and represent you in the appeal process. Claimants who are represented on disability claims in Michigan tend to have a higher rate of approval, a need for fewer appeals, and more favorable "dates of onset" (the date the disability is proven to have begun) that lead to higher back pay benefits.

A qualified disability representative will have a knowledge of Social Security administrative law, particularly with regard to how claims are approved through the Social Security listings and the medical vocational grid rules. A qualified and competent disability representative or lawyer will also be skilled in the ability to obtain the most relevant case evidence, analyze it correctly, and incorporate it as part of a winning strategy for a claim. Contact our offices today at (231) 727-5888 for a confidential consultation about your case.

  • General Civil Litigation

    General Civil Litigation

Unlike criminal prosecution, civil action is a lawsuit brought to court in order to receive damages or to recover a right. Civil litigation usually involves disputes of private law issues between individuals, businesses or non-profit organizations. At the same time, civil litigations can entail public law issues.

A civil litigation lawsuit is started as soon as the plaintiff files a written complaint. The defendant will then respond and deliver a written “answer” to the complaint in order to make any kind of plea.

After the answer is filed the parties engage in the “discovery” process. At this point the parties will learn about all the facts involved in the case in order to prepare the trial. The discovery process includes witness questioning and answering, the exchange of documents, as well as written questions, known as “Interrogatories" or "Request for Admissions".

Whether you are entering the civil litigation lawsuit as the plaintiff or the defendant, it is important to have a qualified and specialized civil litigation lawyer by your side. Our attorneys possess the following skills and knowledge which are essential for litigation.  They include:

    • Knowledge of substantive and procedural law

  • Criminal

    Criminal

Brianna T. Scott's experience as prosecuting attorney makes her uniquely qualified to defend clients who have been accused of OWI/DWI/DUI, felony and misdemeanor charges, drug possession and manufacture, white collar crimes, and juvenile delinquency. Because she has been a prosecutor, she understands how to find weaknesses with investigations conducted by law enforcement agencies, allowing us to build a strong defense strategy to get charges reduced or dropped. She has been very successful in both jury and non-jury cases.

During and after an arraignment, there are many decisions to be made, and it is best to speak with a qualified lawyer. In many circumstances, a lawyer may be able to work out a plea bargain  A plea bargain is, in essence, a compromise. Usually, someone will plead guilty to a lesser crime, and the prosecutor will recommend a lesser sentence to the judge. If a guilty plea is not entered, then the case may go to trial, either in the form of a bench trial or a trial by a jury. Plea bargains may be negotiated and entered until the very end of a trial. Before and during a trial, a criminal defense lawyer will formulate a defense, collect evidence, hire investigators, hire expert witnesses, and prepare for testimony and examination, or questioning. It is possible that a trial will end in a guilty verdict and, thus, sentencing. That is hardly anyone’s desired outcome. That is precisely why it makes sense to work with an experienced attorney. Brianna T. Scott is uniquely qualified to represent those charged with a crime in court. She works to get her cases dismissed, arrange a plea bargain to lessen or eliminate one’s sentence and criminal record and to offer strong representation at trial.

  • Social Security Disability

    Social Security Disability

Our firm has experienced Social Security Disability attorneys who will assist you in obtaining the proper medical documentation to support your condition, prepare you for the appeal hearing and represent you in the appeal process.

Are you suffering from a serious and debilitating illness or injury that is preventing you from being able to work? Are you confused about the process of filing for Social Security Disability Insurance (SSDI), Supplemental Security Income (SSI) benefits? You are not alone. If you find yourself in this situation, do not despair. Our lawyers can help. We have experience in representing disabled claimants throughout the West Michigan area at all levels of the Social Security Disability claims process, and we can help you.

An Experienced Attorney Can Make the Difference in Your Claim

Establishing the validity of your claim can be time-consuming and the guidelines confusing. SSA forms can be misleading and incomplete. It is essential that the medical professionals associated with your case are supportive during the process and provide the documentation that is necessary to assist you in proving your claim for SSDI or SSI benefits. Based on our familiarity with the process, our lawyers will be able to facilitate the vital cooperation and support you will need from your medical providers.

Did you know that at some SSDI-SSI firms, your case isn't even handled by a lawyer? It's true — the law allows non-attorney representatives to present your claim at Social Security's Office of Hearings Operations. You need to carefully consider whether they'll be effective in winning your benefits. After all, whether you'll have monthly income to survive on will depend on their knowledge and skill.

On the other hand, when an experienced Social Security Disability and SSI lawyer handles your case from start to finish, you get a professional who's had years of rigorous law school training in analyzing cases, constructing winning arguments and writing persuasively. All of this is important in winning disability benefits for you.

That's the difference at Brianna T. Scott & Associates, PLLC. All the legal memorandum done on your case is done by attorney Brianna T. Scott herself. From your initial visit through your hearing before an administrative law judge, Brianna T. Scott is with you every step of the way. That means you get superior representation and a better opportunity for a successful outcome.

We want to be the attorneys who help you win your disability claim. Even if your claim has been denied, our attorneys can help. Contact us today! We work on a contingency-fee basis - that means no money up front and no hourly fees. Our fees must be approved by the Social Security Administration (SSA). We file our fee agreement with the SSA in every case.
